Ann Jones v. LIB Express, Inc. et al. (2004)

This case involved a night-time trailer under-ride. Having just passed the road on to which he needed to turn left, the truck driver in this case attempted to turn his truck around by backing his tractor trailer across the on-coming lane of a two (2) lane highway in northern Georgia. As our client approached the intersecting road, she did not appreciate the trailer’s presence until she was right on top of it. She braked hard but ran under the trailer. Fortunately, she and her passenger both ducked down at the last moment and avoided decapitation, but they were both severely injured. The truck did have reflective tape on the side of the trailer, and the defendants alleged that our client was contributorily negligent. In addition to an accident reconstruction expert, we hired a conspicuity expert to analyze the visibility issues and to conduct a night-time visibility study. The study helped negate the defendants’ contributory negligence argument because it showed that the slope of the highway prevented our client from seeing the trailer any sooner than she did. The case settled as we were in the car on the way to the courthouse for trial.

Rebecca Pagdilao v. Youngblood Transportation, Inc (2005)

Our client was severely injured when a Youngblood tractor trailer rear-ended her vehicle on Interstate 95 near the Virginia – North Carolina border. After striking her vehicle, the truck pushed her car several hundred feet before coming to rest. As the vehicle came to a stop, her car burst into flames. She managed to exit the vehicle just before it exploded. She suffered numerous severe injuries. The defense alleged contributory negligence. The parties conducted extensive factual discovery. Numerous liability and damages experts were identified and deposed.
